The parliamentary panel that reviews the WAQF bill distributed a 655 pages report today, incorporating all the changes suggested by its members. However, the opposition has claimed that none of its amendments has been incorporated.

Amid the fear that existing WAQF properties are subject to scrutiny after the law modified in force, the Committee has recommended that there are no cases against such properties retrospectively, provided that the asset is not in dispute or dispute belong to the government.

The committee has accepted 14 amendments, which have been suggested by members of the BJP or its allies.

The bill proposes numerous changes in the way in which the WAQF meetings are administered, including non -Muslim nomination and (at least two) members.

The bill also has a provision that says that the Central Council of WAQF must include a minister of the Union and three parliamentarians, two former judgments, four people of ‘national reputation’ and senior government officials, none of whom need to be of Islamic faith.

In addition, according to the new rules, the WAQF Council cannot claim land.

The opposition leaders have also criticized the committee claiming that a very short time has been allowed to study the draft of the report.

The committee chaired by BJP leader Jagdambika Pal is expected to adopt the report on Wednesday.

“The Parliamentary Committee of the WAQF bill has been reduced to a farce. They told us that the draft of the Committee’s report and its bill will be discussed tomorrow at 10 am,” said DMK leader a slit.

Raja said that parliamentarians are expected to review it, provide comments and send dissent notes.

“This is simply not possible. What is the point of an independent parliamentary committee if the government does what you please,” asked the former minister of the Union?

Key provisions of the WAQF amendment bill, 2025

  • Two Muslim women will continue to be included as members both in the WAQF state boards (Section 14) and in the Central Council of WAQF (Section 9) to guarantee the empowerment and participation of Muslim women in the WAQF management.
  • The WAQF state boards will now include a member of the Muslim OBC community, ensuring a broader representation (Section 14).
  • The state government can establish separate WAQF joints for the communities of Aghakhani and Bohra, recognizing their different religious needs (Section 13).
  • In WAQF Alac Aulad (WAQFS of the family), women’s inheritance rights will be safeguarded. A waqif can dedicate property only after ensuring that female heirs receive their legitimate part (section 3 (2)).
  • WAQF registered by the User will continue to be recognized as WAQF, except in cases where the property is in dispute or property of the government (section 3 (r)).
  • The limitation law will apply to all cases related to WAQF since the beginning of this law, ensuring a timely resolution and avoiding prolonged litigation (Section 107).
  • The online registration process will be introduced to automate the entire life cycle of WAQF properties through the portal.
  • The WAQF boards must load all the details of the WAQF property in a central portal within six months. The WAQF court can grant extensions case by case.
  • If a government property is claimed as WAQF, an officer above the collector’s range, notified by the state government, will carry out an investigation according to the law. Until the report is presented, these government properties will not be treated as WAQF (section 3c).
  • Muslim trusts that work similarly to WAQF but are governed by trust laws will be excluded from the WAQF law, 1995, avoiding legal conflicts (Section 2a).
  • WAQF Alad’s income can be used to support widows, divorced and orphaned women, if specified by the WAQIF (Section 3 (R) (IV)).
  • The purpose of court decisions has been eliminated. Any person harmed now can appeal to the Superior Court within the nineties of the Court’s decision.
  • Online registration certificates of WAQF properties will be issued through the portal.
