Munambam Judicial Panel awaits HC’s verdict about his appointment

The CN Ramachandran Nair commission on the issue of Munambam’s land is waiting for the result of a petition that defies its appointment to decide on its future course of action, even when the state government has clarified that the commission has no powers to judge any questions of title.

The commission, according to the state government, is a mechanism to inform the government of the Munambam land problem. The Commission is not a judicial agency or a quasi -auditory investigation process and has no powers to enforce its recommendations, according to a statement presented by the state government in the Superior Court of Kerala.

The State presented the affidavit in a petition that challenged the appointment of the Commission.

The State argued that the commission was only a investigation authority and that its report only intended to provide the government for appropriate materials to act.

The commission was designated to “identify the present lie, the nature and scope of the property composed in the old survey No. 18/1 of the then Vadakkekara village of the old state of Travancore and to investigate and inform about how to protect the Rights and interests of the occupants of good faith of said land and recommend the measures that the Government will take in that sense. “

The state cabinet decided to appoint the Judicial Commission to investigate the issue of Munambam and present its recommendation to find a permanent solution to the problems involved.

The decision was taken after a meeting of all the parties convened by the main minister following public protests and the consequent agitation and the issue gaining public importance. The Government wants to collect information on the subject, which is legally permissible, the State argued.

The Government has no intention of manipulating the conclusions of any competent court through the commission, as claimed by the petitioners in the case, said the State.

Meanwhile, the panel is waiting for the result of the writing request presented to the Superior Court to decide on its future action course.

“If the Superior Court approves, the panel will continue with its mandate and Submit a report to the government. Currently, the panel has completed the public audience. He has also suggested that interested parties, who are interested in presenting written statements, present them. Some parties have evident interest in presenting the statements, ”said Nair.

Several organizations and individuals had approached the panel with their suggestions and demands with respect to the land of Munambam.
