New Delhi:
The Supreme Court has granted Tahir Hussain, a defendant in the case of Delhi’s riots of 2020 and Aimim’s candidate in the Circumscrip elections.
This means that you can review the surveys from dawn to sunset from January 29 to February 3. He will be released in the morning and back to the Tihar prison at night. Tahir Hussain will have to pay a sum of RS 2 Lakh per day in advance for security arrangements when it is on probation.
A former AAP councilor, Tahir Hussain, is among the defendants in a case related to the murder of the intelligence office official, Ankit Sharma, during the riots in the Northeast of Delhi. It also faces positions of riots and public mischief and is also accused in the case of conspiracy of primary disturbances. He was expelled from AAP after the riots and joined Aimim last year.
The court has said that Tahir Hussain cannot visit his home in Karawal Nagar and is also prohibited from making statements related to the case. However, you can visit the Aimim party office. The bank of Judge Vikram Nath, Judge Sanjay Karol and Judge Sandeep Mehta also said that relief for Tahir Hussain cannot be cited as a precedent.
Previously, the additional attorney general SV Raju had opposed the request for probation, arguing that he would establish an incorrect precedent and that each prisoner would present a nomination to dispute the surveys to get out of jail.
A bank of two judges last week issued a verdict divided into the probation application of Tahir Hussain. This led to the case to move to the bank of three judges.
In the circumscription of Mustafabad in the Northeast of Delhi, Tahir Hussain faces Ahmed Khan of AAP, Mohan Singh Bisht of BJP and Ali Mahndi of the Congress. The seat was won by Haji Yunus of AAP last time.
