A political debate has exploded on the deportation of Indians who tried to enter the United States illegally after a video of them returned.
In the midst of a political debate about the deportation mode of 104 illegal immigrants, which arrived at an airport in Punjab chained and handcuffed, questions have been asked about human treatment for deportees.
The Minister of External Affairs, S Jaishankar, told Parliament on Thursday that the deportation process “was not new” and this has been happening for several years, with 15,668 illegal Indian immigrants deported to India from the United States since 2009.
An American military plane that transports 104 illegal immigrants from several states landed here on Wednesday. Of the deportees, 33 are from Haryana and Gujarat, 30 of Punjab, three each of Maharashtra and Uttar Pradesh, and two of Chandigarh.
Jaishankar declared that the deportations of the United States are administered by the authorities of application of immigration and customs (ICE) and adhere to the established protocols. “The standard operating procedure for aircraft deportations used by ICE that has been effective since 2012, provides the use of restrictions,” he said.
In addition, he said: “However, ICE has informed us that women and children are not restricted. In addition, the needs of deported during traffic related to food and other needs, including possible medical emergencies, are addressed. “
Regarding the bathroom, he clarified that “during the breaks for the toilet, the deportees are temporarily without restrictions if necessary in that sense,” and added that “this is applicable to rented civil planes, as well as military planes.”
Jaishankar also confirmed: “There has been no change in the past procedures for the flight made by the United States on February 5, 2025”.
The opposition parties condemned the alleged treatment of the deported Indians of the United States and criticized the government of the Union for it. His parliamentarians maintained a protest in the Parliament against the deportation of Indians who said were “inhumanly” treated.
Is the deportees allowed to handcuff?
The US immigration authorities follow a structured process by stopping and deporting individuals, according to a BroadCaster report NBC.
Arrests can occur during routine trafficking controls, inspections of the workplace or the raids directed, particularly for those with a criminal record.
Once detained, immigrants move to the facilities operated by the immigration and customs control (ICE), which manages more than 100 centers throughout the country, which collectively places up to 41,500 people.
Depending on their legal status, deportation deadlines vary: those of the United States for less than two years can be eliminated rapidly without an immigration hearing, while others can submit to long legal procedures before facing expulsion.
A final deportation order results in detainees that are taken to the organization of centers at the table, Arizona; Alexandria, Louisiana; San Antonio, Texas; or Harlingen, Texas. From there, they stop for a few days before being transported to airports for extraction, either on commercial flights or one of the 10 dedicated ICE aircraft.
The Trump administration has intensified the removals by displaying military airplanes for deportations. One of those planes, a C-17 Globemaster, came to Amritsar with 140 Indian deportees.
According to ICE policy, all detainees transported on ice air must be completely restricted. This rule has been in force since November 19, 2012. Restrictions include wives, waist chains and leg plates.
Flights within the United States are called Conus flights (Continental United States). Flights to other countries are called Oconus flights (outside the continental United States). The detainees are restricted in both types of flights.
You can only use ice approved restrictions, such as wives and leg plates. The security personnel on board have the authority to restrict any detainee who represents a threat.
Before the doors of the aircraft open at the destination, all restrictions must be removed. Special restrictions such as saliva masks, gloves and orthopedic devices can be used in certain situations. This requires the approval of the officer in charge.
The agreements between the United States and foreign governments with respect to deportation procedures remain in force. These agreements also include rules on the use of restrictions.
SOPS deportation flights
The detainees in deportation flights cannot transport manual luggage. However, they are allowed to bring a pictures that weighs up to 18 kg.
Most detainees are restricted with wives, leg plates and belly chains. However, children and parents traveling with children are not restricted.
Each flight is escorted by 13 to 20 guards. Medical staff is also present to handle health emergencies.
Meals are provided to detainees during traffic.
