The Superior Court of Delhi on Wednesday (January 29, 2025) refused to free the AAP MLA Naresh Balean, arrested in a case of the Organized Crime Crime Law of Maharashtra (Mcoca), on probation to allow him to “guide “His wife playing the next assembly of the next Centro Assembly.
Delhi’s police opposed the granting of probation to the legislator, saying that an investigation in the case was underway and certain witnesses also appeared.
Taking into account the police position, Judge Vikas Mahajan said he was not willing to grant relief, and pointed out that the case of Mr. Bolyan was different from the accused of the riots, Tahir Hussain, whom the Supreme Court gave a similar relief.
“If I had been arranged (Balan), it would have been different. Tahir Hussain is standing differently. He is not disputing. The Supreme Court also said that Tahir Hussain is not a precedent, ”said the court.
The Court published the bail statement of Mr. Bally for a hearing on January 30 after his lawyer said he would not press the relief of probation at this stage.
Mr. Bolyan’s lawyer, Mrs. Khan, said the police apprehension that the investigation would be hindered had no base.
“I will be in custody. How will I go to witnesses? My wife is playing the elections. No one is there to guide her. No one can replace her husband. Nor is the phone offered (in jail), ”he argued.
Referring to the postponement of the Supreme Court for Mr. Hussain, Bolyan urged the court to release him on probation for six hours after the police opposed their interim bail statement in view of the surveys of the Assembly on February 5 .
Police accused Baryan of being a “facilitator” in an organized crime union. He was arrested in the Mcoca case on December 4, 2024, the day when a court of first instance granted the bond in an alleged extortion case.
On January 15, a court of first instance denied freedom on bail to Mr. Bally.
